Terms and conditions

The owner of the online store barest.shoes (hereinafter “Online Store”) is Barest Shoes OÜ (registry code 17081787), located at Pärna tn 1, Võõpsu küla, 64318 Setomaa vald, Võru maakond, Estonia. Contact information: e-mail  info@barest.shoes and phone number +37256653131.

1. Validity of sales agreement, product and price information

These sales terms apply when purchasing goods from the Online Store.

The prices of products sold in the Online Store are indicated next to the products. A delivery fee is added to the price. All prices for goods sold in the Online Store are in euros.

The delivery fee depends on the buyer’s location and the chosen delivery method. The delivery cost is displayed to the buyer during the checkout process.

Information about the goods is provided directly next to the product in the Online Store.

2. Placing an order

To order goods, the desired products must be added to the shopping cart. To complete the order, the required fields must be filled out and the appropriate delivery method selected. The total cost will then be displayed, which can be paid securely using the following payment methods (availability dependent on the billing country):

  • Online bank payments in selected countries
  • Visa/Mastercard card payments
  • PayPal
  • Apple Pay and Google Pay
  • Pay later solutions
  • Gift card

When paying via bank link, be sure to click the “Return to merchant” button after the payment.

Payments are mediated by Montonio.com. Payment is made in a secure environment outside of the Online Store – when paying via bank link, in the secure environment of the respective bank; when paying by credit card, in the secure environment of Montonio. The Online Store does not have access to the buyer’s bank or credit card data.

The contract enters into force after the amount subject to payment has been credited to the bank account of the Online Store. The owner of the Online Store is the controller of personal data and transfers the necessary personal data for payment processing to the authorized processor.

If it is not possible to deliver the ordered goods due to them being out of stock or for another reason, the buyer will be notified as soon as possible, and the paid amount (including delivery costs) will be refunded usually within 1-2 working days, but no later than within 14 days of sending the notice. Depending on the method of payment, the refund may take up to seven working days.

3. Delivery

Goods are delivered to the whole world. However, please note that deliveries to P.O. boxes are not possible.

The buyer has the following delivery options: parcel machines / pickup points, courier standard, courier express.

The cost of delivery is borne by the buyer, and relevant price information is shown next to the delivery method. For some countries the delivery cost may be zero.

Deliveries in Europe typically arrive at the destination specified by the buyer within 1-10 working days from the date the sales contract enters into force.  Click to find more information about delivery times.

In exceptional cases, the Online Store has the right to deliver goods within up to 60 calendar days.

3.1 Deliveries outside the European Union

Deliveries outside of Europe usually take place within 5-30 calendar days, however in exceptional cases, the Online Store has the right to deliver goods within up to 60 calendar days.

For deliveries outside the European Union, local customs duties, import taxes, and other fees may apply depending on the regulations of the destination country. These additional costs are the responsibility of the buyer and are not included in the product price or delivery fee shown at checkout.

Customs procedures may also affect delivery times. The Online Store is not responsible for any delays or charges caused by customs clearance or local import regulations.

3.2 Undeliverable orders

If an order is returned to the online store as undeliverable — for example, due to an incorrect address or contact information or missed delivery notifications — it will be processed as a regular return. In such cases, the online store will refund the order amount minus the actual outbound and return shipping costs once the parcel has been received back at the warehouse.

Customers are responsible for ensuring that delivery information is accurate and that tracking updates provided by the carrier are monitored.

3.3 Lost or missing packages

Once an order has been handed over to the shipping company, responsibility for the shipment transfers to the carrier. The online store is not able to refund or replace orders that are marked as delivered but cannot be located, or that are lost or stolen after delivery. 

If a package appears to be missing, the customer should contact the online store for assistance. The online store will provide support and, if necessary, contact the shipping company to help clarify the situation.

4. Right of withdrawal and extended return policy

4.1 Legal 14-Day right of withdrawal

In accordance with EU consumer protection laws, after receiving the order, the buyer has the right to withdraw from the contract concluded in the Online Store within 14 days without giving any reason.

Please see the section below for our extended 30-day return option, which may apply to your order. This extended policy follows the same rules and conditions that apply to the 14-day withdrawal described here.

The right of withdrawal does not apply if the buyer is a legal entity.

To exercise the 14-day right of withdrawal, the goods may only be handled to the extent necessary to determine their nature, characteristics, and functioning — similarly to how they could be examined in a physical store. Shoes must be unused, in original packaging, and suitable for resale. Please try them on indoors, on a clean surface that does not scratch the soles (preferably on carpet or protective paper), and wear socks or stockings while trying them on. If the product has been used for purposes other than what is necessary to determine its nature, characteristics, and functioning, or if there are signs of use or wear, the Online Store has the right to reduce the refundable amount according to the decrease in the value of the product, considering that the product will be put on sale as a used item.

To return goods, the buyer must submit a withdrawal declaration – Return submit form. The form must be filled out no later than 14 days after receiving the goods (unless the extended 30-day return option is aplicable). If the form is not working for some reason please send an email to info@barest.shoes with all the relevant details.

The cost of returning the goods is generally borne by the buyer, except in cases where free returns are offered. Please refer to the Delivery, Returns & Refunds Information page for details about countries eligible for free returns. Free returns work with shipping company DPD and you have to take your return to your closest DPD pickup-point after receiving specific instructions from the Online Store.

The Online Store will only refund the cost of delivery if the return is due to an error on the Online Store part (for example, if the wrong or defective product was delivered). In such cases, if the buyer has explicitly chosen a method of delivery different from the most inexpensive normal method of delivery offered by the Online Store, the Online Store is not required to refund to the consumer the amount exceeding the cost of normal delivery.

The buyer must return the goods within 14 days of submitting the withdrawal declaration or provide proof that the goods were handed over to the carrier within this period.

Upon receiving the returned goods, the Online Store will refund all payments received from the buyer under the contract without delay, but no later than 14 days from receiving the withdrawal declaration.

The Online Store may refuse to process the refund until it receives the item that is the object of the contract or until the buyer submits proof that the item has been sent back, whichever happens first.

The Online Store has the right to withdraw from the sales transaction and request that the goods be returned by the buyer if the marked price of the goods in the Online Store is significantly lower than the market price of the goods due to an error.

4.2 Extended 30-day return policy

In addition to the statutory 14-day right of withdrawal described above, Barest may offer an extended 30-day return policy. This means that the buyer may return the purchase within 30 days of delivery for a full refund (excluding shipping costs).

This extended policy follows the same rules and conditions set out in the 14-day withdrawal section above.

In general, the cost of return shipping is covered by the buyer, except in cases where free returns are offered. Please refer to the Delivery, Returns & Refunds Information page for details about countries eligible for free returns. Free returns work with shipping company DPD and you have to take your return to your closest DPD pickup-point after receiving specific instructions from us.

5. Right to file a complaint - defective goods claims

The Online Store is liable for the non-compliance of the goods sold to the buyer with the terms and conditions of the contract or for the defects which existed at the time of delivery of the item and which become evident within up to two years of the delivery of the goods to the buyer.

In the event of a defect, the buyer has the right to contact the Online Store no later than within two months after finding out about the defect by sending an e-mail to info@barest.shoes or by calling +37256653131.

The Online Store is not liable for defects that have occurred due to the consumer’s action or inaction (incorrect use, an accident, etc.) after the goods were delivered or in the case of normal wear and tear caused by normal use of the item. If the products bought from the Online Store have defects for which the Online Store is liable, the Online Store will repair or replace the defective goods. If the goods cannot be repaired or replaced, the Online Store will refund all fees incurred under the sales contract to the buyer. Alternatively, and only upon prior agreement with the Online Store, the buyer may organize the repair themselves, and the Online Store may reimburse the cost of such repair.

The Online Store responds to the consumer’s complaint within 15 days in writing or in a format that can be reproduced in writing.

6. Direct marketing and processing of personal data

The Online Store uses the personal data entered by the buyer only to process the order and deliver the goods. The Online Store forwards personal data to transport service providers solely for the purpose of delivering the goods. The Online Store sends newsletters and offers to the buyer’s email address only if the buyer has expressed their wish by entering their email address on the website and agreeing to receive direct marketing messages.

The buyer can opt out of receiving offers and newsletters by email at any time by notifying us via email or following the instructions provided in an email containing an offer.

7. Dispute resolution

If the buyer has complaints regarding the Online Store, they should send them via e-mail to info@barest.shoes or call +37256653131.

If the buyer and the Online Store cannot resolve the dispute through negotiations, the buyer can turn to the Consumer Disputes Committee of their respective country in Europe. The Consumer Disputes Committee is competent to resolve disputes arising from a contract concluded between the buyer and the Online Store. The review of the buyer’s complaint in the committee is free of charge.
